How to Use This Rule Set in UpSheets

  1. Copy the Building and Construction Award rule set from the Award Library and select the Day Worker variant during review.
  2. Assign the correct classification and employment type to each employee using this variant.
  3. Simulate representative shifts, then publish and assign the rule set to affected employees.

Assumptions and Limitations

Assumptions

  • Day workers use clause 16.1 ordinary spread of 7:00 am to 6:00 pm Monday to Friday with an 8-hour daily ordinary cap under clauses 16.2, 16.8, 16.9, and 16.10.
  • Saturday and Sunday are outside ordinary hours.
  • Weekday overtime follows clause 29.4(a) at 150% for the first 2 hours and 200% thereafter.
  • Saturday overtime follows clause 30.1(a)-(b) at 150% for the first 2 hours before 12:00 pm and 200% after 2 hours or after 12:00 pm.
  • Sunday is 200% and public holidays are 250% under clauses 29.9 and 30.1(d)-(e).
  • Casual overtime, weekend, and public holiday multiples use clause 12.5 and 12.6 percentages of the unloaded ordinary hourly rate divided by 1.25 (175%->1.4, 225%->1.8, 275%->2.2).
  • Casual ordinary-hour shift loadings are additive with the 25% casual loading (115%->1.12, 130%->1.24, 150%->1.4).
  • Minimum payments follow clauses 12.3, 29.10, and 30.2: casual Monday to Friday 4 hours, Saturday 3 hours for full-time/part-time and 4 hours for casuals, Sunday and public holiday 4 hours, with Saturday ME tiered 150%/200%.
  • GBC shiftworker is the clause 17.1(b)(i) 5-consecutive afternoon, night, or early morning assignment at 150% Monday to Friday, with weekend overtime under clause 17.1(h) and excess shift hours at 200% under clause 17.1(i).
  • Civil shiftworker uses clause 17.2(j) 115% Monday to Friday, clause 17.2(k) Saturday 150%, Sunday 200%, and clause 17.2(i) overtime at 200%.
  • Civil permanent night uses clause 17.2(n) 130% Monday to Friday.
  • Industry and other all-purpose allowances remain MANUAL and are not baked into base rates.

Not Supported by This Rule Set

  • Apprentice, trainee, national training wage, and supported wage classifications
  • Automatic detection of 5-consecutive, 48-hour-notice, or permanent-night eligibility
  • Civil afternoon or night shift that does not continue for at least 5 successive afternoons or nights
  • Daily hire employees
  • Early start agreements moving the ordinary spread
  • Forepersons and supervisors
  • General building and metal broken shifts of less than 38 ordinary hours over 5 consecutive shifts
  • General building and metal morning and early afternoon shift at 125%
  • Recall and call-out minimum engagements
  • Release-and-pay ordinary time during enforced rest, 20-hour continuous work / 12-hour break, and 8-hour GAP substitution
  • Rostered day off accrual, banking, and work on an RDO
  • Saturday following Good Friday at 250%
  • Time off instead of payment for overtime
  • Weekly overtime beyond an average of 38 ordinary hours
  • Work during meal break and delayed meal break penalties
