Assumptions and Limitations
Assumptions
- Day workers use clause 13.1 Monday to Friday ordinary hours inside 7:00 am to 6:30 pm (no Saturday or Sunday ordinary).
- Outside-span and weekend/public holiday work is overtime under clause 20.2: Monday to Saturday until 12:00 pm first 3 hours at 150% then 200%; Saturday after 12:00 pm and Sunday at 200% with a 3-hour minimum payment; public holidays at 250% with a 3-hour minimum.
- Each day stands alone under clause 20.3(c).
- There is no separate daily ordinary-hour cap; weekly overtime after an average of 38 hours uses the same first-3 / after-3 tiers, with public holiday weekly lines at 250%.
- Casual minimum engagement is 4 hours per day engaged (clause 11.3), day-scoped at the applicable day multiple.
- Non-continuous shiftworkers (other than continuous) use clause 21.3 afternoon/night 115%, early morning 110% (START_ONLY 5:00-6:00 am), permanent-night eligibility via the permanent-night variant at 130%, plus clause 21.4 Saturday 150% ordinary (not overridden by day-worker Saturday-after-noon OT), Sunday 200%, and public holiday 250%.
- Overtime beyond a typical 8-hour shift uses clause 20.2(a) first-3 / after-3 tiers (start_hour 8.0).
- Continuous shiftworkers use flat 200% overtime under clause 20.2(b) and 200% Sunday and public holiday substitution under clause 21.4(b)(i).
- Non-successive afternoon/night 150%/200% tiers under clause 21.3 are not auto-detected.
- Casual OT and shift percentages in clauses 20.2 / 21.3 already include loading (for example OT first 3 hours 175%, after / Sunday 225%, PH 275%).
- Casual MULTIPLE lines are scoped to CASUAL and use (award % of minimum) / 1.25.
- FULL_TIME/PART_TIME multiples remain award percentages of the unloaded minimum.
- Deputy Help Centre has no dedicated Legal Services Award (MA000116 / LSA) article in the Australian awards library, so no Deputy pay-condition cross-check was available; Fair Work award text and MAPD are the sole sources.

- One-hour movement of ordinary span by agreement
- Overtime time rounding to the next 30 or 60 minutes
- Part-time 3 hour minimum engagement
- Pre-spread readiness work counted as ordinary hours
- Public holiday shift major/minor portion allocation across midnight
- RDO accrual and taking arrangements
- Time off instead of payment for overtime
- Unpaid meal break timing, delayed meal penalties, and overtime crib breaks
