Assumptions and Limitations
Assumptions
- Ordinary hours may be worked on any day between 7:00 am and midnight with a 12-hour daily cap and 38 ordinary hours per week (clauses 13.1, 13.3, 13.4).
- Monday to Friday 8:00 am to 7:00 pm is BASE.
- Clause 22 time-of-day ordinary penalties apply inside the span: Monday to Friday 7:00 am to 8:00 am at 150%, 7:00 pm to 9:00 pm at 125%, and 9:00 pm to midnight at 150%; Saturday 7:00 am to 8:00 am at 200%, 8:00 am to 6:00 pm at 125%, 6:00 pm to 9:00 pm at 150%, and 9:00 pm to midnight at 175%; Sunday 7:00 am to 9:00 pm at 150% and 9:00 pm to midnight at 200%; public holidays 7:00 am to midnight at 225%.
- Hours between midnight and 7:00 am are overtime under clause 21.2(d): Monday to Saturday first 2 hours at 150% then 200%, Sunday all at 200%, and public holidays at 250%.
- Daily overtime after 12 hours uses the same Table 5 tiers (Mon-Sat first 2 / after 2, Sunday 200%, public holiday 250%).
- Weekly overtime after 38 hours uses Mon-Sat first 2 / after 2, Sunday 200%, and public holiday 250%.
- CASUAL base rates already include the 25% loading.
- Casual ordinary penalties use MAPD rates inclusive of casual loading divided by 1.25 (for example Monday to Friday morning 175%/125%=1.4, evening 150%/125%=1.2, Saturday 8:00 am to 6:00 pm 150%/125%=1.2, Sunday 7:00 am to 9:00 pm 175%/125%=1.4, public holiday 250%/125%=2.0).
- Clause 21.4(c) provides that casual loading is not payable on overtime, so casual OT multiples are 150%/125%=1.2, 200%/125%=1.6, and 250%/125%=2.0 rather than stacking a further 25% on the overtime percentage.
- The award has no paid minimum-break-between-shifts GAP obligation beyond meal and rest breaks under clause 15.
