Assumptions and Limitations
Assumptions
- Clause 22 has no fixed ordinary-hours spread: ordinary hours average 38 per week, not more than 10 ordinary hours per day, and not more than 5 days per week.
- Default model treats ordinary hours as Monday to Friday only (BASE all-day Mon-Fri 00:00-00:00).
- Without a clause-22 spread, pre/post-spread OT bands are not invented.
- Daily overtime applies after 10 ordinary hours Monday to Friday (first 3 hours then after), not after 8.
- Weekly overtime after 38 hours on EVERY uses the same first-3 / after-3 tiers.
- Saturday whole-day OT tiers are first 3 hours at 150% then 200% (start_hour 0-3 / 3-24).
- Sunday is 200% all day.
- Public holidays are 250% with day, daily-OT, and weekly-OT lines as in SSWA/FBTMA.
- Sunday and public holiday minimum overtime payment is 4 hours under clause 24.5(b) (ME rules).
- There is no general Saturday ME for RS&R adults.
- Clause 24.12(c) less than 10 consecutive hours between duties is a single GAP rule at flat 200%.
- Casual minimum engagement under clause 11.2 is 2 consecutive hours Monday to Friday at ordinary.
- CASUAL base stores the Monday-Friday 6am-6pm ordinary rate including 25% loading (MAPD casual adult = min x 1.25).
- Casual Saturday 11.3 loading is encoded via Sat OT tiers (first 3 at 1.4, after at 1.8) consistent with the weekend-as-OT default.
- FULL_TIME/PART_TIME multiples remain award percentages of the unloaded minimum (1.5 / 2.0 / 2.5; afternoon shift 1.18; night shift 1.30).
- Shiftworkers (clause 25): afternoon shift commencing after noon and not later than 6pm uses START_ONLY 12:00-17:59 at 118% (FT/PT only); night shift commencing after 6pm and not later than 4am uses START_ONLY 18:00-23:59 and 00:00-04:00 at 130% (FT/PT only).
- Shift penalties do not apply on Saturday, Sunday, or public holidays (clause 25.2) - shift START_ONLY windows are Monday to Friday.
- Casuals do not receive clause 25 shift rates (clause 25.1); casuals in the SW variant use the same clause 11.3 loaded-base loadings as day workers.
- Shiftworker OT, Sat/Sun/PH, ME, and GAP structure matches the day-worker model (daily OT after 10 hours).
- Choosing Day Worker versus Shiftworker remains a manual variant assignment; afternoon versus night within Shiftworker is detected via START_ONLY windows.
